Overview

This website and online store are operated by Hedgehog Industries LLC ("Hedgehog Industries," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of hedgehog-fabrication.myshopify.com and any products, downloads, software, plans, documentation, support, content, and services we provide (collectively, the "Services"). By visiting the website, placing an order, downloading a product, activating software, or otherwise using the Services, you agree to these Terms and our Privacy Policy and Refund Policy.

If you do not agree to these Terms, do not use the Services.

Eligibility

You must be at least 18 years old or the age of majority where you live to purchase or use the Services. A minor may use the Services only with the permission and supervision of a parent or legal guardian who agrees to these Terms.

Products and digital delivery

Our products may include digital machine plans, drawings, DXF files, STL files, documentation, Windows software, license keys, and bundles containing these items. Digital products are generally delivered electronically by download, email, license-key issuance, or another method described at checkout. You are responsible for providing accurate contact information, maintaining access to your email account, and checking spam or junk folders.

Product descriptions, specifications, compatibility information, illustrations, pricing, and availability may be corrected or changed without notice. We may refuse or cancel an order for suspected fraud, misuse, pricing errors, unauthorized resale, or other legitimate business reasons. If we cancel a paid order, we will refund the amount collected for the cancelled item.

Software license and license keys

Software is licensed, not sold. Subject to payment and continued compliance with these Terms, Hedgehog Industries LLC grants the purchaser a limited, non-exclusive, revocable, non-sublicensable license to install and use the purchased Mr. Gusset software only within the activation allowance and other entitlements assigned to the purchaser's license key.

Each valid license key currently authorizes up to two machine activations unless the entitlement record for that key expressly states a different allowance. The license key and its corresponding record in our licensing system are the source of truth for what that key includes, including its activation allowance, authorized products or features, status, and any key-specific limitations. A purchase normally includes one license key; replacement or additional keys may be issued only at our discretion after verification.

You may not share, publish, sell, rent, sublicense, reverse engineer, decompile, bypass licensing controls, distribute unauthorized copies, or make the software or license keys available to another person or business, except where applicable law expressly prohibits such restrictions.

Plans and fabrication files

Machine plans and related files are licensed to the purchaser for building and operating Mr. Gusset machines for the purchaser's personal or internal business use. Customers may use an authorized Mr. Gusset machine to manufacture parts, perform paid fabrication work, and sell parts they produce.

You may not reproduce, publish, redistribute, resell, sublicense, or commercially distribute the plans, documentation, DXF files, STL files, or other purchased design files themselves. Purchasing files does not transfer ownership of Hedgehog Industries LLC intellectual property.

License transfers

A software license and associated plan license may be transferred with the machine or business only with our prior written approval. We may require identifying information for the original and new owner, confirmation that the original owner has stopped using all copies, and deactivation of existing keys. After approval, we may issue replacement keys to the new owner. A transfer is not effective until confirmed by Hedgehog Industries LLC in writing.

Support

Build, setup, and operational support is limited to machines built using the official purchased plans, official parts lists, supported configurations, and Mr. Gusset software. Unless we agree otherwise in writing, support does not include alternative controllers, third-party software, custom electronics, custom wiring, modified machine designs, unsupported components, or integrations outside the official system.

Support response times are not guaranteed. We may request diagnostic information and reasonable troubleshooting cooperation before providing replacement files, replacement keys, or other assistance.

Safety and purchaser responsibility

Mr. Gusset is a do-it-yourself CNC plasma-cutting machine. Building, wiring, testing, maintaining, and operating it involves serious hazards, including high voltage, automated motion, rotating components, pinch and crush points, plasma arc radiation, sparks, hot metal, fumes, noise, fire, and potentially fatal injury.

You are solely responsible for determining whether you have the knowledge, training, tools, facilities, supervision, ventilation, guarding, fire protection, personal protective equipment, and legal authority required to build and operate the machine safely. Never operate the machine unattended. Disconnect and secure energy sources before servicing or entering a hazardous area.

You are responsible for complying with all workplace, electrical, fire, environmental, building, machine-safety, export, and other laws and standards applicable to your location and use. Hedgehog Industries LLC does not certify that a customer-built machine complies with any particular regulation, code, or standard.

Orders, prices, and taxes

Prices may change without notice. Prices shown do not necessarily include taxes, duties, currency conversion charges, or other government assessments. You are responsible for charges applicable to your purchase unless checkout states otherwise. We may limit quantities or sales by person, household, business, region, or jurisdiction.

Refunds

Refund eligibility is governed by our Refund Policy, which is incorporated into these Terms. Because our products are digital, purchases are generally final after delivery or access, subject to the exceptions stated in the Refund Policy and rights that cannot legally be excluded.

Intellectual property

The Services and their contents—including software, source and object code, plans, designs, drawings, documentation, text, graphics, branding, videos, photographs, and other materials—are owned by or licensed to Hedgehog Industries LLC and protected by intellectual-property laws. No rights are granted except the limited licenses expressly stated in these Terms.

Acceptable use

You may not use the Services to violate law; infringe intellectual-property or privacy rights; transmit malicious code; interfere with the website or another user's access; obtain unauthorized access; scrape or harvest information unlawfully; misrepresent your identity; or use purchased files, software, or keys outside the license granted above.

Third-party services

The Services may rely on or link to third-party platforms, payment processors, hosting services, carriers, software, or websites. We do not control third-party services and are not responsible for their separate terms, content, availability, security, or acts. Shopify provides the ecommerce platform used by this store.

Disclaimer of warranties

To the fullest extent permitted by law, the Services are provided "as is" and "as available." We disclaim implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, compatible with every system, or suitable for every project or regulatory environment. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

Limitation of liability

To the fullest extent permitted by law, Hedgehog Industries LLC and its owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenue, data, business, or opportunities, arising from the Services, products, files, software, machine construction, or machine operation.

To the fullest extent permitted by law, our aggregate liability arising from a claim will not exceed the amount you paid to Hedgehog Industries LLC for the product giving rise to that claim during the twelve months before the event. These limitations do not apply where prohibited by law or to liability that cannot legally be limited.

Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Hedgehog Industries LLC and its owners, officers, employees, contractors, and agents from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful use of the Services, violation of these Terms, infringement of another person's rights, unauthorized distribution of licensed materials, or unsafe or noncompliant construction or operation of a machine.

Informal dispute resolution and governing law

Before filing a legal claim, you and Hedgehog Industries LLC agree to attempt in good faith to resolve the dispute informally. The complaining party must send a written notice describing the dispute and requested resolution. The parties will allow at least 30 days after receipt of the notice to seek a resolution.

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules. Unless applicable consumer law requires otherwise, legal proceedings that cannot be resolved informally must be brought in a state or federal court with jurisdiction serving Mecklenburg County, North Carolina, and each party consents to that venue and jurisdiction.

Changes and termination

We may update these Terms by posting a revised version and changing the "Last updated" date. Changes apply prospectively when posted unless law requires otherwise. We may suspend or terminate access for violation of these Terms, fraud, security threats, or misuse. Provisions that by their nature should survive termination—including license restrictions, intellectual property, disclaimers, liability limitations, and dispute terms—will survive.

Severability and entire agreement

If a provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. These Terms, together with the Privacy Policy, Refund Policy, product-specific terms, and any written license terms supplied with a product, form the agreement between you and Hedgehog Industries LLC concerning the Services.
